What is Medical Malpractice?

Sometimes, medical care or procedures have bad outcomes, including being injured or dying. However, not all bad outcomes are caused by negligence. Four elements are typically required for a medical malpractice claim to move forward:

  3. Causation: The deviation from the accepted standard of medical care caused the patient to suffer harm/injury, or death.
  4. Damages: The patient suffered harm/injury, or death that can be compensated.
