What is Medical Malpractice?
Medical malpractice occurs when a healthcare professional or facility provides care that falls below the accepted medical standard, resulting in harm to the patient. Simply put, it’s a failure to meet the level of care that a competent professional in the same field would have likely provided in the same situation, especially when that failure hurts a patient in some way.
Usually, success in a medical malpractice claim requires the plaintiff to prove the following four elements:
Duty: The medical provider owed a duty of care to the patient, which usually exists in a doctor-patient relationship.
Breach: The medical provider breached that duty by failing to act according to the accepted standard of care.
Causation: The provider’s negligence caused harm or injury to the patient.
Damages: The patient suffered measurable harm, whether physical, emotional, or financial, that can be compensated.
Types of Medical Malpractice Cases We Handle
Medical malpractice can take many forms depending on what the medical provider did wrong. Our legal team at James Wood Law has been working on medical malpractice claims and lawsuits for many years, so we have seen just about every imaginable case type possible. If you have been hurt by a medical provider’s errors, we want to hear your story.
You can come to us for help with a medical malpractice claim that involves:
Misdiagnosis or delayed diagnosis: Failing to recognize symptoms of a serious illness. Also, incorrectly diagnosing a condition, leading to delayed or improper treatment.
Surgical errors: Operating on the wrong body part or patient, leaving surgical instruments or materials inside a patient, or performing unnecessary surgeries. Failing to provide inadequate postoperative care can also be considered a type of surgical error.
Medication errors: Prescribing the wrong medication or dosage or failing to consider adverse drug interactions before prescribing or administering a medication.
Birth injuries: Harm to the newborn, such as brain injuries or broken bones, that usually happen shortly before, during, or after birth.
Anesthesia errors: Administering too much or too little anesthesia. Also, failing to monitor the patient’s vital signs during the procedure.
Failure to obtain informed consent: Performing a procedure without properly informing the patient of the risks and alternatives.
Common Causes of Medical Malpractice
By its definition, medical malpractice results from preventable errors that reasonably would not have happened if another medical provider had been in the same situation.
Some of the most common causes include:
Fatigue: Medical professionals often work long hours, which causes exhaustion and lapses in judgment.
Breakdowns in communication: Miscommunication between doctors, nurses, or lab technicians can lead to errors in diagnosis or treatment.
Understaffing: Hospitals with inadequate staff may overlook important details or fail to provide proper care to patients in need.
Poor training or supervision: Healthcare providers who lack proper training or are improperly supervised may make critical errors that jeopardize patient safety.
Failure to follow established procedures: Deviating from medical protocols can result in adverse outcomes for patients that otherwise would not have happened.
Damages in a Medical Malpractice Case
If you’ve been a victim of medical malpractice, you may be entitled to pursue financial compensation for your losses. Our goal is to carefully calculate all the damages owed to you, so we can pursue every last penny that should be provided to you by the liable party or parties.
We help clients pursue a variety of damages in medical malpractice cases, including:
Economic damages: Medical expenses such as hospital bills, surgeries, rehabilitation, and future care needs. Lost wages are also considered economic damages if you were unable to work due to your injuries, as is a diminished earning capacity if you can no longer return to your previous role or salary.
Non-economic damages: Pain and suffering endured as a result of the malpractice, emotional distress (depression, anxiety, or trauma), and loss of enjoyment of life if your injuries have impacted daily activities or relationships are three common types of non-economic damages.
Punitive damages: In cases of gross negligence, a court might approve of punitive damages, which punish the healthcare provider for particularly reckless or intentional misconduct. However, punitive damages in medical malpractice cases are rare, so they might not apply to your case.
